GoThriva is an adventure discovery and booking platform that helps users explore, compare, and book outdoor and adventure experiences — including paragliding, rafting, bungee jumping, skydiving, trekking, camping, ziplining, and related activities.

Unless expressly stated otherwise, GoThriva acts as a platform and booking facilitator connecting users with independent third-party partners, activity providers, pilots, guides, and vendors. The actual experience is conducted by the relevant partner or provider.

You must be at least 18 years old to make a booking through GoThriva.

If you book for another person, including a minor, you confirm that you are authorized to act on their behalf and have obtained all necessary permissions and consents. You agree to these Terms on behalf of all participants in the booking.

Certain activities may have minimum or maximum age, weight, height, health, or fitness requirements. It is your responsibility to ensure every participant meets the eligibility conditions of the selected activity.

Adventure and outdoor activities involve inherent risks. These may include, without limitation: injury, illness, fear, panic, discomfort, loss or damage to personal property, delays, weather-related disruption, technical malfunction, negligence of third parties, serious bodily harm, or death.

By booking or participating in any activity through GoThriva, you acknowledge and accept that:

• Adventure activities involve risks that cannot be completely eliminated
• Participation is entirely voluntary
• You understand the nature of the selected activity
• You assume full responsibility for your decision to participate

GoThriva is not the activity provider for every listing on the platform unless expressly stated. Unless specifically mentioned:

• GoThriva does not directly conduct, pilot, guide, or operate the activity
• The partner is solely responsible for the execution, safety, conduct, staff, equipment, and delivery of the activity
• GoThriva does not guarantee that any activity will be uninterrupted, error-free, or suitable for every individual
• GoThriva is not responsible for on-ground decisions made by partners for safety, weather, technical, or operational reasons

All bookings are subject to availability, operational feasibility, weather, and confirmation. A booking is considered confirmed only when:

• The applicable payment is successfully received, and
• A confirmation is sent by GoThriva or the relevant partner

GoThriva reserves the right to reject, hold, or cancel any booking in the event of pricing errors, suspected fraud, duplicate transactions, safety concerns, partner unavailability, technical issues, or violation of these Terms.

All prices are listed in Indian Rupees (INR) unless stated otherwise. Prices may change at any time before booking confirmation. Once confirmed, the confirmed amount is payable and binding.

By making a booking, you agree to pay the full amount displayed at checkout, including any applicable taxes, gateway charges, convenience fees, or other charges disclosed at the time of payment.

Payments are processed through third-party gateways. GoThriva is not responsible for any delay, chargeback, processing error, downtime, bank failure, or transaction failure caused by payment partners or financial institutions.

Cancellation, rescheduling, and refund eligibility depend on the activity, location, partner policy, weather conditions, timing of the request, and operational constraints. Unless stated otherwise:

• Cancellation requests are subject to the cancellation policy applicable to that booking
• Rescheduling requests are subject to availability and partner approval
• Late arrivals and no-shows may not be eligible for any refund
• Partially used, interrupted, or voluntarily abandoned experiences are generally non-refundable
• Transaction charges, platform fees, and third-party payment charges may be non-refundable

If an activity is delayed, shortened, rescheduled, or cancelled due to weather, water conditions, visibility, technical reasons, government orders, or safety assessments, GoThriva or the partner may at their discretion offer rescheduling, a booking credit, a partial refund, or a full refund — depending on the specific situation and partner policy. Refund timelines vary by payment method and provider.

Many activities listed on GoThriva are weather-dependent. Activities may be delayed, modified, shortened, relocated, rescheduled, or cancelled due to factors including but not limited to:

• Wind speed, rain, or low cloud cover
• River conditions or visibility
• Take-off or landing conditions
• Equipment safety checks
• Traffic restrictions or government advisory
• Staff, pilot, or guide judgment on any circumstance affecting participant safety

All safety-related decisions made by the partner, pilot, guide, instructor, or authorized staff are final and must be followed without exception.

You agree that you and all participants in your booking will:

• Provide accurate and complete booking information
• Comply with all instructions, rules, briefings, and safety requirements
• Report on time at the designated location
• Carry valid identification where required
• Wear suitable clothing, footwear, and gear
• Avoid reckless, abusive, or disruptive conduct
• Not participate under the influence of alcohol, drugs, or any intoxicating substance
• Truthfully disclose any medical, physical, or psychological condition that may affect participation

Failure to comply may result in refusal of participation without refund.

Some activities may not be suitable for individuals with certain medical conditions. You must not participate in an activity if you are or may be affected by conditions including, without limitation:

• Heart conditions or serious blood pressure issues
• Severe anxiety or panic disorder
• Epilepsy
• Recent surgery, fractures, or mobility limitations
• Neck, back, or respiratory issues
• Pregnancy
• Any condition that may create additional risk during the activity

By booking, you confirm all participants are medically and physically fit for the selected activity unless disclosed in advance and accepted by the partner. GoThriva and the partner reserve the right to deny participation if a participant appears medically unfit, intoxicated, or ineligible.

Participants may be required to sign additional waivers, declarations, indemnities, consent forms, or safety acknowledgements provided by the partner before the activity begins.

Partner-specific rules, instructions, limitations, and eligibility conditions form part of the booking terms. In the event of any safety-related conflict between these Terms and a partner's on-ground instructions, the stricter safety requirement shall apply.

Participants are responsible for arranging their own travel to the reporting point unless expressly included in the booking. GoThriva is not responsible for missed activities, delays, or losses caused by:

• Traffic, roadblocks, or transport breakdown
• Weather or personal scheduling issues
• Inaccurate arrival estimates
• Failure to follow reporting instructions

Reporting late may result in reduced activity time, rescheduling charges, denial of participation, or no refund.

Activities may be photographed or recorded by partners, pilots, guides, or staff for operational, safety, or memory purposes.

Where legally permitted, you agree that photos or videos captured during the experience may be shared with you and may also be used by GoThriva or its partners for promotional, social media, website, advertising, or marketing purposes.

If you do not want your image or likeness used for promotional purposes, please inform GoThriva in writing at support@gothriva.com before the activity.

If you submit reviews, ratings, feedback, photos, videos, or other content to GoThriva, you grant GoThriva a non-exclusive, worldwide, royalty-free, transferable right to use, reproduce, publish, display, distribute, and promote such content in connection with its business and marketing.

You confirm that:

• The content is accurate to the best of your knowledge
• You own the content or have the right to share it
• The content does not violate any law or third-party rights
• The content is not abusive, defamatory, obscene, misleading, fraudulent, or infringing

GoThriva reserves the right to remove or moderate user content at its discretion.

You agree not to:

• Use the platform for any unlawful or fraudulent purpose
• Make speculative, false, or misleading bookings
• Misuse discounts, offers, coupons, or referrals
• Interfere with the platform's functionality or security
• Scrape, copy, reproduce, or commercially exploit content without permission
• Impersonate another person or entity
• Upload harmful code, spam, malware, or misleading content
• Harass, threaten, or abuse partners, staff, or other users

The GoThriva platform may contain links to third-party websites, payment gateways, partner pages, maps, communication tools, or other services.

GoThriva does not control and is not responsible for the availability, content, terms, privacy practices, actions, or omissions of third-party services. Your use of any third-party service is at your own risk and may be subject to separate terms.

All content on GoThriva — including text, design, graphics, branding, logos, images, videos, icons, layout, software, and platform materials — is owned by or licensed to GoThriva and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, display, publish, sell, or exploit any part of the platform without prior written permission from GoThriva.

The platform and all services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, GoThriva disclaims all warranties, express or implied, including but not limited to warranties regarding:

• Availability, merchantability, or fitness for a particular purpose
• Accuracy of listings, uninterrupted service, or non-infringement
• Partner conduct, safety, quality, or suitability of any activity

GoThriva does not guarantee that the platform will always be available, secure, or error-free.

To the maximum extent permitted by law, GoThriva, its founders, directors, employees, affiliates, contractors, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or remote damages, including but not limited to:

• Injury, death, or emotional distress
• Travel loss, missed schedules, or property damage
• Loss of profits, loss of data, or business interruption
• Reputational loss or refund disputes caused by partner actions
• Failure or delay in activity delivery

This limitation applies whether the claim arises in contract, tort, negligence, strict liability, or otherwise. Where liability cannot be excluded under applicable law, GoThriva's total aggregate liability shall not exceed the amount actually paid by you for the specific booking giving rise to the claim.

You agree to defend, indemnify, and hold harmless GoThriva, its affiliates, directors, employees, representatives, partners, and service providers from and against any claims, actions, damages, losses, liabilities, costs, and expenses, including legal fees, arising from or related to:

• Your breach of these Terms or misuse of the platform
• Your violation of any law or third-party right
• Your participation in any activity, or the participation of any person booked by you
• False declarations, inaccurate information, or non-disclosure by you
• Injury, loss, or dispute caused by your conduct

GoThriva shall not be liable for any failure, delay, suspension, or cancellation caused by events beyond reasonable control, including but not limited to:

• Natural disasters, landslides, floods, or storms
• Pandemics or government restrictions
• Civil unrest, strikes, or road closures
• Network failures, technical outages, or safety alerts
• Partner disruptions or weather conditions

GoThriva may suspend, restrict, or terminate your access to the platform or cancel any booking if it reasonably believes that:

• You have violated these Terms
• You have engaged in fraud or abuse
• Your conduct poses a risk to safety, operations, staff, or other users
• There is a legal, technical, or operational reason requiring such action

Your use of GoThriva is also subject to our Privacy Policy, which explains how we collect, use, store, process, and share personal information. By using the platform, you consent to the handling of your information in accordance with our Privacy Policy.

GoThriva may update these Terms from time to time. Any changes will become effective when the revised Terms are posted on the website, unless otherwise stated. Your continued use of the platform after such changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and interpreted in accordance with the laws of India. Any dispute arising out of or relating to these Terms, the platform, or any booking made through GoThriva shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan, India.
